Do NOT ever distribute plants without the proper Trial Agreements.
Without proper plant patent protection or a proper trialing agreement, anyone you give a “sample” to can take your new plant introduction and call it their own. Plants Nouveau will supply trialing agreements to anyone who gets samples. From home gardeners to garden writers and from tissue culture labs and mailorder nurseries to large, respected licensed growers – don’t trust anyone without the proper trialing agreement – no matter how well you know them.
The moment someone talks about your plant online, you start the clock ticking. You have one year from that point to get your patent in place; after that year is up your plant is not patentable anymore. In today’s world, this means no posting pictures with a name on Facebook or Instagram – anything on the internet. It can take 2-3 years to get a plant through trialing and often five years or more to get the plant into the market in large numbers. The horticulture industry is full of genuinely honest people, mostly; but there’s always that small chance and you shouldn’t risk losing introduction and royalty rights to your new plant.
Don’t take it personally if we can’t use the names you want for your plants.
We will make every effort to honor plant name requests, but if there is a conflict or if it will prevent a proper nomenclature registration, we can’t make any promises. Plants Nouveau will do what is in the best interest for marketing purposes.

“Don’t become the problem. Once the process has begun you need to be kept informed of what is going on. In most cases that is a quarterly or bi-annual notification of your plant’s status. You can even insist on this in your contract, but don’t make the mistake of calling weekly to get updates. They are your babies, but once in the system, it will simply take time. Be proactive, but don’t be a pest.”

At Plants Nouveau we realize they are YOUR plants and we know we would not have the honor of introducing them for you if YOU hadn’t given them to us so, PLEASE…call every day, email every hour, request visiting rights. Don’t be afraid to ask ANYTHING! Our main goal is to have open communication with our plant breeders and for them to be happy. If breeders are happy, they keep coming back to us with new plants. See, it’s easy to do that when that’s your main goal, so choose Plants Nouveau for that very reason – We LOVE our plant BREEDERS!
And finally…We will NEVER introduce a plant that may harm or have the potential to harm wildlands because it is invasive. We will make every effort to avoid introducing invasive plants (in accordance with the Center for Plant Conservation regulations). No matter how beautiful it is, no matter how novel it is, and more importantly, no matter how many millions we could sell, it’s not our thing and we will not be involved.
Sorry…but someone’s gotta take a stance! If you bring us a new introduction that is potentially invasive, we will be honest and forthright with you from the start.

Plants Nouveau is a company about plants! We are fueled by the introduction of novel, innovative selections from real plant people. Royalties collected by Plants Nouveau are shared with the plant’s originator and re-invested into the program’s marketing efforts.
Evaluation is a top priority!
Plants Nouveau will evaluate your selection in many different regions of the country and abroad to achieve maximum exposure to extreme climatic conditions. We utilize botanic gardens, municipalities, university testing programs, licensed nurseries in extreme climate zones, and garden writers for evaluating our introductions. Each site is required to report on the plants yearly. We also have a team of horticultural experts gathered from around the world who evaluate and give input on a yearly basis.
To introduce a new selection with confidence about its performance, we will adhere to strict evaluation timelines.
We collect the royalties for you.
Licensed growers pay a fee per plant sold. A royalty fee is collected per plant sold on introductions registered federally and internationally through plant patents and plant breeder’s rights. Twice a year, we pay our originators their share of the royalties collected from the sales of their new plant.
We pay for all costs associated with protecting and marketing your new selection unless you want to. There doesn’t need to be any cost to you. You just sit back and collect your share of royalties from the sales of your novel plant.
The country’s best nurseries want to grow our plants!
We license the largest, best-known, and most reputable nurseries and grower groups in the US, Canada, and throughout the world. We sometimes offer exclusives to increase market demand. We have a licensing policy that affords plant originators who work with our program the maximum royalty revenue possible.
Big nurseries producing large quantities = Increased Royalty Revenue
Our international presence and worldwide reputation allow us to reward our originators with royalty incomes and international recognition for their new selections.
While our primary market is in the United States, we have a national and international presence. Potentially, 100’s of nurseries from the United States can be licensed to grow your new introduction. We also register plants and apply for Plant Breeder’s Rights with the Canadian Ornamental Plant Foundation (COPF) and the European Union (EU), Japan, Australia, New Zealand, and beyond.
We are working to co-introduce our introductions with the best plant introduction companies in the European Union, The United Kingdom, Australia, and New Zealand, and throughout Asia.
Innovative, on-trend marketing
We will market our introductions through several venues. If it is a series of similar products, we develop a clever name or logo to represent the series. We will also work to develop point-of-purchase materials and targeted, paid advertisements with trade publications to increase demand. We help our Licensed Growers sell your plants by working with large retail outlets and home stores to raise interest in our products through trial programs and regular product presentations.

Your plants will be featured
We exhibit and showcase your new introductions at the most popular horticulture trade show in the US, Cultivate, in Columbus, Ohio. This is the best show in the US for featuring new plants. We will also regularly submit our new plants to the most popular US trade and consumer publications new product sections and special features.
Our experience with new product placement in popular media publications affords Plants Nouveau the ability to get the most exposure for little investment by utilizing long-standing relationships with national and international garden writers.
Utilizing mailorder for FREE exposure to millions, Plants Nouveau realizes mailorder catalogs have a large consumer customer base. By offering initial sales in limited quantities through successful, well-known mailorder catalogs, the program and its introductions receive countless amounts of FREE press and exposure to millions of consumers. We are also working with TV plant sales like QVC.
